Welcome to nuvó, provided by nuvo.coach ("we", "us", "our"). By using the nuvó mobile application ("the App"), you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the App.

2. Description of Service

nuvó is an AI-powered life coaching application that helps users set and achieve personal goals across three domains:

  • Happy — mental wellness and personal growth
  • Healthy — physical health and vitality
  • Wealthy — financial health and confidence

The App provides AI-generated coaching conversations, goal tracking, daily check-ins, and progress monitoring.

3. Important Disclaimer

nuvó is not a substitute for professional advice. The AI coaching provided by the App is for general informational and motivational purposes only. Specifically:

  • nuvó does not provide medical, psychological, psychiatric, or therapeutic advice. If you are experiencing mental health issues, please consult a qualified healthcare professional.
  • nuvó does not provide certified financial advice, investment recommendations, or tax guidance. For financial decisions, please consult a licensed financial advisor.
  • nuvó does not provide personal training certifications or medical fitness assessments. Consult a healthcare provider before starting any new exercise program.
  • AI-generated responses may occasionally be inaccurate, incomplete, or inappropriate. Use your own judgment when acting on any coaching suggestions.

4. Account Responsibilities

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 16 years old to use the App
  • You may not share your account with others
  • You are responsible for all activity that occurs under your account

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App's systems or other users' accounts
  • Interfere with the proper functioning of the App
  • Use automated systems (bots, scrapers) to access the App
  • Attempt to reverse-engineer, decompile, or extract the source code of the App
  • Use the AI coaching system to generate harmful, abusive, or illegal content

6. Fair Use Policy

PRO subscriptions include generous usage limits designed to support normal personal coaching use. To ensure a high-quality experience for all users and prevent abuse, the following fair use limits apply to PRO accounts:

  • Up to 100 coach messages per day
  • Up to 30 AI goal generations per month
  • Up to 50 active goals

These limits are well beyond typical usage. If you consistently reach these limits, we may contact you to discuss your usage. We reserve the right to throttle or suspend accounts that engage in automated or abusive use of the AI coaching features.

7. Subscriptions and Payments

7.1 Free and PRO Plans

The App offers a free tier with limited features and a PRO subscription with additional capabilities. Feature availability and limits are described within the App.

7.2 Payment Processing

All payments are processed by Apple App Store (iOS) or Google Play Store (Android). We do not process or store your payment information directly. All subscription purchases, renewals, and cancellations are subject to the terms of the respective platform:

7.3 Cancellation

You may cancel your subscription at any time through your Apple or Google account settings. Upon cancellation, you retain PRO access until the end of your current billing period. We do not offer refunds directly — refund requests must be made through Apple or Google.

8. Intellectual Property

  • The App, including its design, code, content, AI coaches, and branding, is the intellectual property of nuvo.coach
  • You retain ownership of the content you create (goals, messages, progress data)
  • By using the App, you grant us a limited license to process your content as necessary to provide the service
  • You may not copy, modify, distribute, or create derivative works based on the App

9. AI-Generated Content

The App uses artificial intelligence (powered by OpenAI) to generate coaching responses. You acknowledge that:

  • AI-generated content may not always be accurate, complete, or appropriate
  • AI coaches are fictional characters and do not represent real people
  • You should exercise your own judgment when acting on AI coaching suggestions
  • We are not liable for any decisions you make based on AI-generated advice

10. Limitation of Liability

To the maximum extent permitted by law:

  • The App is provided "as is" and "as available" without warranties of any kind
  • We do not guarantee uninterrupted, error-free, or secure service
  • We are not liable for any indirect, incidental, special, or consequential damages
  • Our total liability is limited to the amount you paid for the App in the 12 months preceding the claim

11. Termination

  • You may delete your account at any time by contacting us at support@nuvo.coach
  • We may suspend or terminate your account if you violate these Terms
  • Upon termination, your right to use the App ceases and your data may be deleted in accordance with our Privacy Policy

12. Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will notify you through the App or by email. Continued use of the App after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms shall be submitted to the competent court in the Netherlands.
